Welcome to TubePrompter. These Terms of Service ("Terms") govern your use of the TubePrompter website and services operated by SHENYAN AI LLC ("Company," "we," "us," or "our").

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

1. Description of Service

TubePrompter is an AI-powered video analysis and prompt generation tool that:

• Analyzes publicly available video thumbnails from platforms like YouTube
• Extracts visual elements such as camera angles, lighting, and composition
• Generates structured AI prompts optimized for Gemini 2.5 Flash Image, OpenAI Sora, Google Veo, and other image/video generation models
• Provides scene-by-scene breakdown with start and end frame prompts
• Offers remix functionality to customize prompts while preserving visual DNA

2. Account & Subscription

Account Registration

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Subscription Tiers

TubePrompter offers the following subscription plans:

• Free: 1 video analysis per day with basic features
• Plus: 10 video analyses per day with expanded features
• Pro: Unlimited video analyses with full feature access

Billing

Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date.

3. Refund Policy

We want you to be satisfied with our service. Our refund policy is as follows:

• Within 7 days: You may request a pro-rated refund within 7 days of your subscription purchase or renewal
• After 7 days: No refunds will be issued after the 7-day window
• Processing: All refunds are processed through Stripe and may take 5-10 business days to appear on your statement
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period

4. Email Communications

By creating an account, you consent to receive:

• Service emails: Account verification, password resets, subscription confirmations, usage alerts, and important service updates
• Marketing emails: Product announcements, tips, and promotional offers (opt-out available)

You may opt out of marketing emails at any time by using the unsubscribe link in any marketing email or by contacting us. Service-related emails cannot be opted out of while your account is active.

5. AI-Generated Content Disclaimer

TubePrompter uses AI (Google Gemini) to analyze videos and generate prompts. You acknowledge that:

• AI-generated prompts and analysis results may not always be accurate or complete
• We do not guarantee specific outcomes when prompts are used with third-party AI tools (Sora, Veo, Midjourney, etc.)
• Image generation results may vary depending on the model used and its current capabilities
• Content may be filtered or blocked by AI safety systems beyond our control
• You are solely responsible for how you use the generated prompts and any content created from them

6. Intellectual Property

Your Prompts: You retain ownership of any original prompts you create or customize using our service. You are free to use, share, and distribute your prompts.

Platform IP: The TubePrompter service, including its design, prompt templates, analysis algorithms, and technology, is owned by SHENYAN AI LLC and protected by intellectual property laws.

YouTube Content: Videos analyzed through our service remain the property of their respective creators. We do not claim ownership of any third-party video content. You are responsible for ensuring your use of generated prompts does not infringe on the rights of content creators.

7. Usage Limits & Fair Use

Our service operates on a quota system with daily limits based on your subscription tier. You agree to the following fair use terms:

• Do not use automated scripts, bots, or scrapers to access the service
• Do not attempt to circumvent or manipulate usage quotas
• Do not share account credentials to exceed per-user limits
• Do not resell or redistribute the service or its outputs commercially without permission
• Do not use the service to generate harmful, abusive, illegal, or deceptive content

We reserve the right to suspend or terminate accounts that violate these fair use terms.

8. Data Privacy

Your use of TubePrompter involves the following data processing:

• Authentication: Account data is managed through Supabase Auth
• Storage: Analysis results and user data are stored in Supabase
• Payments: Subscription and billing data is processed by Stripe
• Analytics: Usage patterns are tracked via Google Analytics (GA4) and Vercel Analytics
• AI Processing: Video thumbnails are sent to Google Gemini for analysis

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHENYAN AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the service
• Any inaccuracies in AI-generated content or analysis
• Unauthorized access to or alteration of your data
• Third-party conduct or content on the service
• Any other matter relating to the service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws
• Abuse of the service or other users
• Fraudulent or unauthorized activity

Upon termination, your right to use the service will cease immediately. If you have an active paid subscription at the time of termination for cause, no refund will be issued.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our website or sending an email to registered users. Your continued use of the service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of competent jurisdiction.
